Arizona Employee Sanctions
Effective January 1, 2008, a law went into effect for all Arizona Employers including state, government, corporate, or self employed.
Under this law, any employer that knowingly employs an unauthorized person is subject to civil sanctions including suspension or revocation of all licenses held by said employer.
Please be advised this is not a legal opinion. For that you would need to contact an attorney. Please note that there are contradictions in the laws and the rules. For example, one line reads "employ" while the E-verify program states "after hiring an employee." In addition, there is an ongoing attempt to have the law declared void in the courts, and there are proposed amendments to clarify the law in the legislature.
My recommendation is that you complete all paperwork (i.e. W-9, state withholding form, and the Employment Eligibility Verification I9) and keep it in an individual file by employees.
You should also register for E-verify to confirm the employability of your hire. Use of this program creates a rebuttal of presumption.
